In the aftermath of last summer’s bushfires, the DSE recently announced new temporary vegetation clearance entitlements to enable people to reduce fuel loads around buildings used for accommodation.
These entitlements, referred to as the “10/30 right”, enable the clearance of vegetation:
· Within 10 metres of buildings used for accommodation – any vegetation, including trees;
· Within 30 metres of buildings used for accommodation - any vegetation, except trees;
Siteholders no longer have to obtain a planning permit to clear vegetation in these areas. Instead they must complete an application form and submit it to DSE, who will forward it to the ARMB to review. The application must be approved by the ARMB prior to the commencement of any vegetation removal.
The ARMB:
· must decide if proposed clearing is appropriate in sensitive environmental areas.
· has discretion to disallow clearing or allow it in part or in full.
· can not authorise clearing in excess of the “10/30 right” without a planning permit.
Punitive measures will apply to any siteholders who remove vegetation without written permission from the ARMB.
