2027 Ski and Snowboard School Seasonal Program Terms & Conditions

GENERAL CONDITIONS

1. DEFINITIONS:

In these conditions unless there is something in the subject or content inconsistent therewith:

1.1 ‘Act’ means the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law

1.2 ‘Applicant’ means the person purchasing a Ski & Snowboard School Seasonal Program Product.

1.3 ‘B-Tag’ means a piece of RFID media that when activated provides access to the Ski Lifts and lunch vouchers.

1.4 ‘Claim’ means any claim, demand, action or proceeding in relation to the performance or non-performance of the services, products or any other obligation under these conditions, whether arising under the law of contract, equity, tort (including negligence), strict liability, breach of statutory provision or otherwise.

1.5 'Company' means Buller Ski Lifts Pty. Ltd, trading as Mt Buller Ski & Snowboard School ABN 20 006242066 its directors, officers, employees and agents and its related bodies corporate as defined in the Corporations Act 2001 (Cth).

1.6 ‘Cutoff Date’ means the last date an applicant may take advantage of a discounted rate as stated on the Website from time to time.

1.7 ‘Event’ refers to any on-mountain or off mountain competition

1.8 ‘eStore’ means the online retail website for the sale of the Company’s services and products to consumers.

1.9 ‘Fee’ refers to the amount payable for the provision of service as outlined in the seasonal program offer.

1.10 ‘Prescribed Terms’ means any terms, conditions and warranties which the law (including the Act) expressly provides may not in respect of these conditions be excluded, restricted or modified, or may be excluded, restricted or modified only to a limited extent.

1.11 “Seasonal Program” refers to the products as offered by the Ski & Snowboard School which include, Snow Squad X, Snow Squad Mini, Snow Squad Evolution, Snow Squad Rider, Snow Squad Masters or; any other program as may be promoted from time to time.

1.12 ‘Ski Lifts’ means such lifts as may be operated by the Company at the Resort from time to time during the Snow Season

1.13 ‘Snow Season’ means the period in each calendar year during which the Company shall operate the Ski lifts which period is proposed to commence on or about the Kings Birthday weekend and is proposed to expire on or about 30 September PROVIDED THAT the Company may in its absolute discretion determine in accordance with the snow and/or weather conditions prevailing on any particular day or days during the Snow Season, the quality and the nature of the Ski Lifts (if any), the services and facilities to be operated or offered by the Company on that day

1.14 ‘Snow Dough’ means the stored value facility that may be linked to a B-Tag.

1.15 ‘These conditions’ means these conditions including the General Terms,

1.16 ‘Vouchers’ means benefits, gifts or promotional items provided to a Holder at the Company’s sole discretion.

1.17 ‘Website’ means the online store accessed through 'shop.skibuller.com.au' or ‘www.mtbuller.com.au’ and content supplied by the Company for that site.

2. GENERAL:

2.1 If you are purchasing any product or service from the Company on behalf of another person, you make that purchase as the agent of the other person.

2.2 The participant shall comply with the provisions of the ALPINE RESPONSIBILITY CODE.

2.3 The participant acknowledges and agrees that the Company may in its absolute discretion determine in accordance with the snow, slope, and/or weather conditions prevailing on any particular day or days during the Snow Season the quantity and the nature of the Ski Lifts (if any), the services and the facilities to be operated or offered by the Company on that day or days and the Holder further acknowledges and agrees that he or she shall not be entitled to any refund, credit or transfer in respect of the Seasonal Program Product with which he or she has been issued if any of the ski lifts and/or the services and the facilities are not operated or offered by the Company for any reason whatsoever for any period during the Snow Season.

2.4 These conditions are governed by the laws of the State of Victoria and the Courts of which will have exclusive jurisdiction.

2.5 If a provision of these conditions is found to be unenforceable it shall be severed from these conditions and all remaining provisions will remain of full legal effect.

2.6 The Company may alter these conditions by giving 30 days notice at any time. Notice will be given online at the Website.

3. FEES

3.1 Fees for seasonal programs: Snow Squad X, Snow Squad Evolution, Snow Squad Rider & Snow Squad Mini, include tuition for 180 hours of supervised coaching (30 days as specified, 6 hours per day). These hours may include indoor activities as specified by the coaches or supervisors.

3.2 Fees for Snow Squad Masters seasonal program include tuition for 24 hours of coaching (8 days as specified, 3 hours per day).

3.3 No discounts, credits or refunds will be issued for non-participation or missed program days, due to weather, illness, or other voluntary or involuntary circumstance.

3.4 Seasonal programs: Snow Squad X, Snow Squad Evolution, Snow Squad Rider & Snow Squad Mini fees also include a lunch on the days of the program. Lunches cannot be redeemed for cash or for Snow Dough if any unused portion is not consumed during the relevant snow season. Lunches are only valid on program dates. Note: Snow Squad Masters does NOT include lunch.

3.5 Program fees do not include lift access. Lift passes must be purchased separately. It is the responsibility of each participant to bring their B-TAG (loaded with lift access) with them each program day in order to access the lifts, and to abide by the rules and terms of use of the lifts and lift access.

4. EVENTS & RACES

4.1 All Ski & Snowboard School’s seasonal programs will be conducted at Mt Buller within the dates outlined each season.

4.2 Events conducted at other resorts within Australia are not included as part of the Ski & Snowboard School seasonal program offerings. Ski & Snowboard School seasonal program participants who wish to compete in events at other resorts and have their instructor accompany them, can do so outside of the seasonal program dates by booking their instructor each day at the standard private lesson rate.

4.3 Seasonal programs (Snow Squad X, Snow Squad Rider & Snow Squad Evolution) coaches may encourage entry into events conducted at Mt Buller with the prior approval of the Ski & Snow Squad Program manager. Such events may include:

a) Snowracer Competitions
b) Moguls Competitions

4.4 Seasonal program fees do not include event entry fees.

5. GROUPS/COACHES

5.1 Every attempt will be made to accommodate requests for coaches and groups but cannot be guaranteed.

5.2 Participants are matched with the appropriate coach and group at the discretion of the Program Supervisor, Ski and Snowboard School Manager and Seasonal Program coaches. Changes may be made to groups after the start of the program.

5.3 Every attempt will be made to keep the same coach for each group throughout the entire season. However, BSL reserves the right to substitute coaches due to illness, injury or other situations deemed necessary by the Program Coordinator or Ski and Snowboard School Manager. This includes using key staff to assist with the conduct of hosting the Victorian or Australian Interschool Snowsport Championships.

5.4 No refunds or credits will be given in the event of non- participation due to changes of coaches or groups.

6. SNOW SQUAD JACKET

6.1 A Snow Squad jacket is a requirement to participate in Snow Squad X, Snow Squad Mini, Snow Squad Rider & Snow Squad Evolution only. Participants may opt to purchase a jacket in the checkout process at an additional cost ($405) We are required to order jackets 8 months in advance and every attempt will be made to accommodate a request, however it may be necessary to modify requests. Note: Snow Squad Masters does not have a team jacket.

7. SNOW SQUAD SEASONAL PROGRAM DAYS OFF

7.1 The Seasonal Program Coordinator will schedule 2 days off for Snow Squad X, Snow Squad Mini, Snow Squad Rider & Snow Squad Evolution groups during the June/July School Holiday period.

7.2 Program participants in Snow Squad X, Snow Squad Mini, Snow Squad Rider & Snow Squad Evolution will be allocated specific days and notified by the Ski & Snowboard School at least 5 days prior.

7.3 The days off scheduled will be at the sole discretion of the Ski & Snowboard School and Buller Ski Lifts.

8. PROMOTION & PHOTOGRAPHY

8.1 Parents of Snow Squad X, Snow Squad Mini, Snow Squad Rider & Snow Squad authorize Buller Ski Lifts to undertake photography of your child whilst skiing or riding and participating in the Snow Squad programs. These photographs may be used for promotion of Snow Squad programs, the Mt Buller Ski & Snowboard School or Mt Buller in a variety of mediums including but not limited to:

The Mt Buller website & Online Store
Printed materials
Electronic Communication

Snow Squad Instagram Account

8.2 By signing this release form and purchasing a Snow Squad program you and/or your child have no recourse to seek payment for any photography used for promotional purposes.

9. SNOW SQUAD SEASONAL ATTENDANCE REQUIREMENTS

9.1 The seasonal program requires a minimum commitment of a minimum of 10 days over the June/July school holiday period.

10. WITHDRAWL FROM PROGRAM - ADMINISTRATION FEE

10.1 An administration fee will be applied to participants withdrawn from the program prior to the commencement on the following schedule:

· Prior to June 12th 2027 - $250

· Between June 12th & 25th June 2027 - $550

· After the commencement of the program - June 27th 2027- $950.

10.2 The administration fee will be deducted from the refund provided

1.12 “Ski Lifts” means such lifts as may be operated by the Company at the Resort from time to time during the Snow Season.

1.13 “Snow Season” means the period in each calendar year during which the Company operates the Ski Lifts. This period is proposed to commence on or about the King’s Birthday weekend and is proposed to expire on or about 30 September. The Company may, in its absolute discretion and having regard to the snow and/or weather conditions prevailing on any particular day or days during the Snow Season, determine the quality and nature of the Ski Lifts, services and facilities to be operated or offered on that day or those days.

1.14 “Snow Dough” means the stored-value facility that may be linked to a B-Tag.

1.15 “These Conditions” means these terms and conditions, including the General Conditions.

1.16 “Vouchers” means benefits, gifts or promotional items provided to a Holder at the Company’s sole discretion.

1.17 “Website” means the online store accessed through shop.skibuller.com.au or www.mtbuller.com.au, together with content supplied by the Company for those sites.

2. GENERAL

2.1 If you purchase any product or service from the Company on behalf of another person, you make that purchase as the agent of that person.

2.2 The Holder must comply with the provisions of the Alpine Responsibility Code.

2.3 The Holder acknowledges and agrees that the Company may, in its absolute discretion and having regard to the snow, slope and/or weather conditions prevailing on any particular day or days during the Snow Season, determine the quantity and nature of the Ski Lifts, services and facilities to be operated or offered on that day or those days.

The Holder further acknowledges and agrees that they will not be entitled to a refund, credit or transfer in respect of their Seasonal Program product if any Ski Lifts, services or facilities are not operated or offered by the Company for any reason or for any period during the Snow Season.

2.4 These Conditions are governed by the laws of the State of Victoria, Australia. The courts of Victoria will have exclusive jurisdiction.

2.5 If any provision of these Conditions is found to be unenforceable, that provision will be severed from these Conditions and all remaining provisions will remain in full force and effect.

2.6 The Company may amend these Conditions by providing 30 days’ notice. Notice will be provided online via the Website. The current version of these Conditions will be available at:

3. FEES

3.1 Fees for the Masters Seasonal Program include tuition for 24 hours of supervised coaching, comprising eight days of coaching at three hours per day.

3.2 No discounts, credits or refunds will be issued for non-participation or missed program days due to weather, illness or any other voluntary or involuntary circumstance.

3.3 Program fees do not include lift access. Lift passes must be purchased separately.

Each participant is responsible for bringing their B-Tag, loaded with the required lift access, with them on each program day in order to access the Ski Lifts. Participants must comply with all applicable rules and terms of use relating to the Ski Lifts and lift access.

3.4 Participation in the program is subject to the participant meeting the required skiing ability standard. Participants must have an advanced-intermediate level of skiing ability; a minimum Level 6 standard is recommended.

The Ski & Snowboard School will assess each participant’s ability on the first day of the program. The Company reserves the right to cancel an enrolment and provide a credit for monies paid if the participant does not meet the required ability standard.

Participant acknowledgement:

☐ I agree that my skiing ability will be assessed on the first day of the program and acknowledge the requirements outlined above.

4. GROUPS AND COACHES

4.1 Every effort will be made to accommodate requests for particular coaches or groups; however, such requests cannot be guaranteed.

4.2 Participants will be matched with an appropriate coach and group at the discretion of the Program Supervisor, Ski & Snowboard School Manager and Seasonal Program coaches. Group allocations may be changed after the commencement of the program.

4.3 Every effort will be made to retain the same coach for each group throughout the season. However, Buller Ski Lifts reserves the right to substitute coaches due to illness, injury or other circumstances considered necessary by the Program Supervisor or Ski & Snowboard School Manager.

This may include the use of key staff to assist with the conduct of the Victorian or Australian Interschool Snowsport Championships.

4.4 No refunds or credits will be provided where a participant does not participate due to changes to coaches or groups.

5. PROMOTION AND PHOTOGRAPHY

5.1 By purchasing a Snow Squad program and participating in the program, you authorise Buller Ski Lifts to photograph or otherwise capture images of you while skiing, riding or participating in Snow Squad activities.

These photographs may be used for promotional purposes relating to Snow Squad programs, the Mt Buller Ski & Snowboard School or Mt Buller, across a variety of mediums, including but not limited to:

• The Mt Buller website and online store
• Printed promotional materials
• Electronic communications
• Other promotional or marketing materials

5.2 By agreeing to these Conditions and purchasing a Snow Squad program, you acknowledge and agree that you will not be entitled to payment, compensation or any other consideration for the use of photographs taken of you for the promotional purposes described above.

6. WITHDRAWL FROM PROGRAM - ADMINISTRATION FEE

6.1 An administration fee will be applied to participants withdrawn from the program prior to the commencement on the following schedule:

· Prior to June 12th 2027 - $250

· Between June 12th & 3^rd July 2027 - $550

· After the commencement of the program – July 4^th 2027- $750.

6.2 The administration fee will be deducted from the refund provided
